Terms of Service
Softgarden (we call ourselves "the Company") owns and runs the game and the website at softgarden.space, plus anything else connected to it. All of that together is the "Services." Read through these terms carefully. When you use the Services, you're saying you accept them. Don't use the Services if you don't agree. We can change these terms whenever we want, and if you keep using the Services after we update them, that means you accept the new version. Same goes for any new features we add unless we say otherwise. Check back here once in a while to see if anything changed.
GAMING & CONDUCT RULES
The Services exist for community, relaxation, integrity and fun. Follow the rules and enjoy yourself. This part covers account creation, in-game features, and what you can't do. User Accounts. You get one account per platform or device. We suggest you stick to one account across everything, but if you don't and run multiple accounts on different devices, they can't talk to each other or interact in any way. If we catch them interacting, we'll ban, reset, or punish one or more of those accounts. Virtual Goods Transfers & Account Sales. Content from Softgarden—including in-game money and virtual items—can't be sold, traded, or turned into real money. Trying to do this breaks the terms and can get your account banned for life or lead to legal trouble. All virtual goods and currency sales are final, no refunds. You can't convert them back to real money either. The Company can manage, change, modify, or get rid of virtual currency and goods however it wants, and we're not responsible to you for doing that. You're liable for everything charged to your account, whether you did it or someone who got into your account did. If your account gets terminated or suspended for any reason, you lose all virtual goods and currency. General Conduct & Prohibited Acts. Some things aren't allowed. You can't: Use the Games if you're under 13. Pick an account name that disrespects other players. Run Bots, Auto-Clickers, Hacks, Exploits, or do anything else against our Rules and Policies. Call out other players for cheating in any in-game communication channel. That includes forums, private messages, status updates, and chat. If you actually think someone's cheating and have proof, contact us through the form on our site. Post, upload, email, send, or share any material that's unlawful, harmful, threatening, abusive, harassing, mean-spirited, defamatory, vulgar, obscene, pornographic, sexually-explicit, libelous, invades someone's privacy, hateful, or racially or ethnically offensive. Don't post anything that encourages crime, creates legal liability, breaks any law, or is just objectionable. Share material that violates someone else's intellectual property, privacy, or publicity rights. Make available material you don't have the right to share. Post false or misleading information or anything designed to look true when you know it's wrong, misleading, or fake. This includes impersonating another user or our staff, or anything that could harm minors. Mess with the Services (including security features), servers, or networks connected to them. Don't ignore any rules, procedures, policies, or requirements for those networks. Don't probe, scan, test, breach, or get around any security or authentication measures. Break any local, state, national, or international law or rule, whether you mean to or not. Resell the Services, their content, or access to them. Do anything else these Terms say you can't do. Action by Company. Any prohibited activity can lead to your post or thread being deleted from chat, forums, or your profile wall. Your account might be limited, blocked, suspended, or terminated temporarily or permanently depending on how serious the violation is. We can apply whatever other punishments we think are right. Availability. We can change, pause, or shut down the Services anytime for any reason without warning. Maintenance or equipment problems might make the Services unavailable. We can add or update information and materials without telling you. We reserve the right to change and update the Games whenever we decide it's necessary.
INTELLECTUAL PROPERTY, OWNERSHIP AND CONTENT RULES
We care about protecting intellectual property. This section explains who owns what and the rules around content. Copyright and Trademark Information. The Services and everything in them belong to us and our licensors. Copyright law, trademark law, international treaties, and other IP laws protect them from being copied or spread without permission. All our product names and logos are our trademarks or registered trademarks. Other company and product names and logos belong to their owners in certain countries. Nothing on the Services gives you a license or right to use them or anything displayed here through framing or any other method, unless we give you written permission first. Feedback & Suggestions. If you send us suggestions, comments, or feedback, we can use it in the Services or any other products or services we make. You agree that we don't have to keep feedback confidential, it's not secret or proprietary information, you have the right to share it with us, and we and our successors can freely use, copy, publicize, license, distribute, and commercialize it. You won't get paid or reimbursed for any feedback you give us. Content. All information, data, messages, and materials on the Services—posted publicly or sent privately—are the responsibility of whoever posts or sends them. We don't control this content and don't guarantee it's accurate, complete, or high quality. Using the Services means you might see material that's offensive, indecent, or objectionable. Partner Terms of Service. We follow the terms of service for our platform partners like Facebook, Apple, Google, and Android. You've read and agree to follow the terms of service for whatever platform you're using to access our Services. Know what their terms say and don't break them, because that can get you banned.
LIABILITY AND RISK TERMS
To offer the Services, we have to limit what we're responsible for. Release. We don't control how users interact with each other or with other people and companies. We don't control credit card companies or payment processors. We can't guarantee users are who they say they are or how old they are. Because we have almost no control over the quality, safety, morality, legality, truthfulness, or accuracy of what's in the Services, you accept all risk. You agree to release us and our officers, directors, shareholders, agents, employees, affiliates, subsidiaries, and third party partners from any claims, demands, or damages connected to your use of the Services or any third party transactions. We specifically disclaim all claims, guarantees, and conditions—express, implied, statutory, by trade usage, course of dealing, or otherwise—including any implied warranties of merchantability, non-infringement, title, satisfactory quality, or fitness for a particular purpose. Anything you download or get from the Services is at your own risk. You're responsible for any damage to your computer, loss of data, or other loss from downloading or using material from here. We don't guarantee, endorse, or take responsibility for any content or materials in the Services, any products or services advertised or offered by third parties through the Services, any services you can reach through a link on the Services, or anything in ads or banners. We're not involved in any transactions you make with third parties. LIMITATION OF LIABILITY. You'll protect us and our affiliates, officers, agents, platform partners, and employees from all claims, threats, actions, lawsuits, demands, damages, losses, obligations, costs, and expenses—including reasonable attorney fees—made by anyone because of material you submitted, posted, sent, or shared through the Services, any way you violated these Terms, or any way you violated someone else's rights (including intellectual property, publicity, personality, or privacy rights).

We're not responsible for what's on those linked sites. Any third-party services or services you reach from the Services have their own terms and conditions. You have to figure out what those are and follow them. Termination. We can stop your access to the Services or parts of it immediately and without warning under certain circumstances. Reasons include breaking these Terms or any other agreement with us (like not paying fees), requests from law enforcement or government agencies, your own request, us changing or shutting down the Services or parts of it, unexpected technical, security, or legal issues, or you participating directly or indirectly in fraud or illegal activity. You understand and accept that we decide to terminate in our sole discretion and we're not liable to you or anyone else for terminating your access or removing your content. If your account gets terminated or cancelled by you or by us, you don't get a refund and you can't access Site Content anymore. Any termination is in addition to any other rights or remedies we have. We can't and don't make any claims or guarantees about how secure communication to or from the Website is or whether third parties might intercept your personal or other information. Updates.
